Court Dismisses Bolarinwa’s Suit Against APC

The suit challenging the authenticity of Alhaji Abdullahi Samari, the acting Kwara State All Progressives Congress (APC) Caretaker Chairman, and Mai Mala Buni, the National Caretaker Chairman, over the suspension of Bashir Omolaja Bolarinwa as the State’s Caretaker Chairman was dismissed by an Ilorin High Court today.

Recall that 11 members of the party have been contesting the validity of Acting Caretaker Chairman Abdullahi Samari since January 29, 2021.

A fine was levied on the complainant for wasting the court’s time, according to Justice S.M Akanbi’s decision.

Justice S.M Akanbi said the court lacks jurisdiction over the matter since internal remedy by the party has not been exhausted by the claimants.

Justice Akanbi said the process was not endorsed, faulty and do not comply with the law, stressing that the claimants failed to approach any relevant committee like NEC before approaching the court.

He said the party that came to court lacks the jurisdiction because Bolarinwa who is directly affected did not challenge the decision of the party, meaning he is satisfied by the action of the party.

He revealed that though the claimants claimed to be executives of the caretaker committee they were not suspended or removed that it is the suspended Chairman (Bolarinwa) who was supposed to champion the matter not members of the executive.

In an interview with the Counsel for APC, Bar. Jimoh Lawal, said the judgement is another victory for the party as it indicates that suspending Bolarinwa is right and in line with the law.

He expressed confidence that even if they appeal, his client will always win because all issues raised were resolved in his favour.
