Trump Issues Executive Order to Establish National AI Policy Framework

The United States President, Donald J. Trump has signed a new executive order aimed at positioning the country for global dominance in artificial intelligence (AI), setting the stage for a national regulatory framework that overrides what he described as “cumbersome and ideological” state-level laws.

 

The order, issued on Friday from the White House, seeks to ensure that no state legislation impedes innovation in the fast-evolving AI sector, which the Trump administration says is crucial to America’s economic and national security interests.

 

Trump said the decision follows his earlier Executive Order 14179 of January 23, 2025, which dismantled regulations introduced by the previous administration.

 

He maintained that several states have enacted AI laws that create a “patchwork of 50 different regulatory regimes,” making compliance difficult for emerging companies and potentially embedding “ideological bias” into AI systems.

 

He cited a recent Colorado law banning “algorithmic discrimination,” claiming such legislation could force developers to generate inaccurate outputs to avoid perceived bias.

Trump also criticised state laws that attempt to regulate beyond state borders, describing them as obstacles to interstate commerce.

 

To counter these developments, the President ordered the establishment of an AI Litigation Task Force under the U.S. Attorney General.

 

The team is mandated to challenge any state law deemed inconsistent with the administration’s policy of ensuring a “minimally burdensome” national AI framework.

 

Within 90 days, the Secretary of Commerce is also expected to publish an evaluation of existing state AI laws, identifying those considered excessive or unconstitutional.

In addition, the order introduces financial consequences for non-compliant states.

 

The Department of Commerce is to issue a policy making such states ineligible for certain federal funds under the Broadband Equity Access and Deployment (BEAD) programme.

 

Federal agencies are also directed to review their discretionary grant programmes and determine whether to restrict funding to states that enact conflicting AI laws.

 

The Federal Communications Commission (FCC) is further tasked with evaluating the adoption of a national reporting and disclosure standard for AI models—one that would supersede state requirements.

 

The Federal Trade Commission (FTC) is to issue a policy clarifying that state laws compelling AI tools to produce deceptive outputs may be preempted by federal law.

 

The executive order also directs Trump’s Special Advisor for AI and Crypto, alongside senior science and economic officials, to draft legislation that would formally establish a unified national AI policy.

 

The proposed legislation will, however, leave room for states to regulate issues such as child safety, government procurement, and certain infrastructure matters.

 

Trump said the administration’s goal is to ensure that American companies remain at the forefront of the global AI race, stressing that “the United States must win.”

 

The White House noted that the order does not create any enforceable legal rights for individuals and will be implemented subject to applicable laws and funding availability.
