High Court Orders Interlocutory Injunction Against Rivers State Lawmakers

In a significant judicial decision, the Rivers State High Court in Port Harcourt has issued an interlocutory injunction against 27 members of the Rivers State House of Assembly. These members, led by Martin Amaewhule, have been barred from acting as lawmakers, INCNews247 can report.
Justice Charles Wali of the Rivers State High Court, Port Harcourt division, granted the injunction under case number PHC/1512/CS/2024.
The plaintiffs in this case, Victor Oko Jumbo and two other lawmakers loyal to Governor Siminalayi Fubara, named Martin Amaewhule and 24 other defected Assembly members as defendants.
The case also included Governor Fubara, the state’s Attorney General, and the state’s Chief Judge as parties.
The court’s order specifies:
– Restraint on Legislative Activities: The 1st to 25th defendants are restrained from presenting themselves as members of the Rivers State House of Assembly. They are prohibited from meeting or conducting any legislative business at the House of Assembly Quarters or any other location. Their legislative seats have been declared vacant pending the hearing and determination of the substantive suit.
– Interaction Ban: The 26th to 28th defendants are prohibited from engaging with the 1st to 25th defendants. This includes accepting any resolutions, bills, or other forms of interaction in their purported capacities as Assembly members. The legislative seats are officially vacant from December 13, 2023.
The court has scheduled the hearing for the substantive suit on July 1, 2024.
