Court Dismisses First Petition Filed Against Tinubu’s Victory

The Presidential Election Petition Court in Abuja has Monday dismissed one of the five petitions filed against Bola Tinubu’s victory in the February 25 poll.

The case was dismissed by a five-member panel of the court led by Haruna Tsammani after the petitioner’s lawyer announced its withdrawal.

The court’s inaugural sitting assured all litigants that it would do justice to all parties involved in the case. Lawyers committed to cooperate with the court in response.

The panel members took a short break after the court’s ceremonial opening and returned to hear the case of Action Alliance, AA.

However, there was confusion about the legal representative of the party when their case was called, with two lawyers announcing appearance for the party.

The court recognised the lawyer who filed the petition, and shortly after, the lawyer announced the withdrawal of the case.

The respondents’ lawyers representing Tinubu and INEC did not object to the application for the withdrawal of the petition, and the court subsequently dismissed the petition.

The Action Alliance has urged the court to nullify the polls due to the alleged refusal of INEC to upload the name of its actual presidential candidate, Solomon-David Okanigbuan, to its portal for the February poll.

Recall, in January, the National Chairman of Action Alliance, Adekunle Omo-Aje, stated that Hamza Al-Mustapha recognised by INEC was not the authentic presidential candidate of the party, following a leadership tussle in the party that gave rise to the emergence of two presidential candidates.
